für die happinoa® App

1. Geltungsbereich

Dieser Endnutzer-Lizenzvertrag („EULA“) regelt die Nutzung der App happinoa®, bereitgestellt durch die JOTIBO UG (haftungsbeschränkt), Deutschland („Anbieter“).

Mit dem Download, der Installation oder Nutzung der App erklärst du dich mit den Bedingungen dieses Vertrags einverstanden.

2. Leistungsbeschreibung

happinoa® ist eine App zur persönlichen Orientierung, Selbstreflexion und strukturierten Begleitung im Alltag. Die App bietet dialogbasierte Impulse, strukturierende Inhalte sowie KI-gestützte Begleitung.

happinoa® ist kein Therapie-, Diagnose- oder Medizinprodukt und ersetzt keine ärztliche, psychotherapeutische oder medizinische Beratung.

3. Nutzungslizenz

Der Anbieter gewährt dir ein nicht exklusives, nicht übertragbares und widerrufliches Nutzungsrecht zur Verwendung der App auf eigenen Endgeräten im Rahmen dieses Vertrags.

4. Premium- und Abonnements

happinoa® bietet optionale kostenpflichtige Abonnements (z. B. Premium). Der Abschluss, die Abrechnung, Verlängerung und Kündigung erfolgen ausschließlich über den jeweiligen App Store gemäß den dort geltenden Bedingungen.
iOS: Abonnements werden über den Apple App Store abgeschlossen, abgerechnet und verwaltet.
Android: Abonnements werden über Google Play abgeschlossen, abgerechnet und verwaltet.

5. Pflichten der Nutzer:innen

Die App darf nicht missbräuchlich, rechtswidrig oder in einer Weise genutzt werden, die andere Personen oder Systeme schädigt.

6. Haftungsausschluss

Die Nutzung der App erfolgt auf eigene Verantwortung. Der Anbieter übernimmt keine Haftung für Entscheidungen, die auf Basis der App-Inhalte getroffen werden.

8. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland. Sollte eine Bestimmung dieses Vertrags unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Scope

This End User License Agreement (“EULA”) governs the use of the happinoa® app, provided by JOTIBO UG (haftungsbeschränkt), Germany (“Provider”).

2. Description of Service

happinoa® is an app for personal orientation, self-reflection, and structured daily guidance. It provides dialog-based impulses, structured content, and AI-supported guidance.

happinoa® is not a medical or therapeutic product and does not replace professional medical or psychological advice.

3. License Grant

The Provider grants you a non-exclusive, non-transferable, revocable license to use the app on your personal devices in accordance with this agreement.

4. Subscriptions

happinoa® offers optional paid subscriptions. Subscriptions are processed exclusively via the respective App Store and are subject to their respective terms and conditions.
iOS: Subscriptions are purchased, billed, and managed through the Apple App Store.
Android: Subscriptions are purchased, billed, and managed through Google Play.

5. User Obligations

You agree not to misuse the app, submit unlawful content, or use the app in a way that harms others.

6. Limitation of Liability

Use of the app is at your own risk. The Provider is not liable for decisions made based on app content or for service interruptions.

7. Data Protection

8. Final Provisions

This agreement is governed by the laws of the Federal Republic of Germany. If any provision is held invalid, the remaining provisions shall remain in effect.
